This application u/s 482 Cr.P.C. has been moved with the prayer to direct the court below to decide the bail application moved by applicant in Case Crime No. 474 of 2008, under Section 302, 120B, 436 IPC registered as Case No. 3750 of 2009, P.S. Bhadohi, District Bhadohi.
Learned counsel for the applicant contends that his bail application is not being disposed of by the court below only because the original record of the Case Crime No. 474 of 2008, under Section 302, 120-B and 436 IPC (Case No. 3750 of 2009) State Vs. Nazim @ Sanu, has been summoned by this Court in Criminal Revision No. 4092 of 2009 (Smt. Ujma Khan Vs. State of U.P. and another), while hearing the said revision vide order dated 19.4.2010. It is prayed that a direction may be issued for return of the said lower court record to the court below for disposal of the bail application of the accused-applicant.
Heard learned counsel for the applicant, learned A.G.A. and perused the record.
Prayer is very genuine. Perusal of record shows that the aforementioned record had been summoned in Criminal Revision No. 4092 of 2009 by court's order dated 19.4.2010, and the same is reported to be still lying in this Court, because of which the bail application of the accused-applicant is not being disposed of by the court below.
Office is directed to send back lower court record with a direction to the court below that it shall return the same after disposing of the bail application within one month positively.
Let a copy of this order be transmitted to the court concerned through District Judge concerned for compliance of this order strictly in time.
This application is accordingly, disposed of.
