Heard Shri Madhaw Prasad, learned counsel for the petitioners and Shri Gulab Singh, learned Standing Counsel for the State respondents.
The petitioners are before this Court with request to issue direction to the respondent no.4, Assistant Collector/Tehsildar, Tehsil Sadar, District Maharajganj to executing the order dated 31.12.2015 passed by the respondent no.3, Sub Divisional Magistrate, Tehsil Sadar, District Maharajganj in Civil Suit No.192 of 2015 (Bhajjan vs. Bhaggan) under Section 41 of U.P. Land Revenue Act, 1901 within stipulated time.
The matter was taken up on 10.12.2019 and on the said date the Court had asked to learned Standing counsel to seek necessary instructions in the matter.
On the matter being taken up today, Shri Gulab Singh, learned Standing Counsel has placed detailed instructions dated 16.12.2019 sent by the Sub Divisional Magistrate, Tehsil Sadar, District Maharajganj indicating therein that in response of the order dated 31.12.2015 in presence of revenue officials, police/women police force and in presence of the villagers the Patthar Nasab has been ensured in the matter on 14.11.2019 and illegal encroachment, which was made on the land in dispute, has already been removed. The relevant photograph has also been appended alongwith the instruction. The instruction is taken on record.
In this backdrop, learned Standing Counsel submits that so far as the order dated 31.12.2015 passed by the respondent no.3 in Civil Suit No.192 of 2015 is concerned, the same has been complied with.
So far as factual and legal aspect of the matter is concerned, the same has not been disputed by learned counsel for the petitioner.
Accordingly, in terms of the aforesaid instructions, the present writ petition is disposed of.
