JUDGMENT / ORDER

Heard learned Counsel Mr. J.M.Budhbhatti appointed through legal aid for the applicant and Mr. I.M.Pandya, APP for the respondent.
Rule.
Learned A.P.P. Mr. I.M.Pandya waives service of rule on behalf of the respondent.
This is an application for condonation of delay of 125 days that has occasioned in preferring Criminal Appeal no.470 of 2007.
Considering the averments made in the application, I am satisfied that sufficient cause is shown for condoning the delay as prayed for. Accordingly, application is allowed. Delay is condoned. Rule is made absolute.
