High Court Of Gujarat|16 June, 2012

JUDGMENT / ORDER

(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) After hearing the learned counsel for the parties and after going through the materials on record, we find that presence of the applicant is necessary for effective disposal of the main public interest litigation. We accordingly allow this application by making the applicant, namely National Highway Authority of India as an additional respondent. Learned Advocate for the petitioner is directed to add National Highway Authority of India as party respondent and to serve copy of the application upon the added respondent by next Thursday, June 21, 2012. Let affidavit-in-reply, if any, be given by the additional respondent by June 28, 2012. Let the matter appear on June 28, 2012. The interim relief granted earlier be extended till that date.
Petitioner is at liberty to file supplementary affidavit annexing the photographs showing that in spite of the interim order restraining the respondent from giving tender, actual felling of tree has started.
