Shri Manish Jaiswal, learned counsel for the petitioner submits that this petition is between the parties which are the parties in Original Suit No.1931 of 2002 (Sarbari Begum vs. Nasir Khan), which is pending before the court of Additional Civil Judge (J.D), Court No.8, Allahabad.
On the basis of the order sheet, annexed as annexure No.3 to the petition, learned counsel for the petitioner submits that the suit is at the stage of evidence of the plaintiff. It is noted that in the present matter, the petitioner is defendant and an interim injunction is in currency against him.
Considered the submissions and perused the record.
The petition is disposed of in the light of the judment passed by the Hon'ble Supreme Court in the matter of M/s Shiv Cotex vs. Tirgun Auto Plast P. Ltd and Others 2011 (89) ALR, 232 with the direction to learned trial court to take all possible endeavour to decide the suit, expeditiously preferably within a period of one year from the date of production of a certified copy of this order, without granting any unnecessary adjournment to either of the parties
