Heard Sri Ashish Kumar Gupta learned counsel for the applicants and learned A.G.A and perused the record.
The instant application is being moved by the applicants namely, Nashrin Begum and Anwar Ali invoking the powers of Section 438 Cr.P.C. that they have every reason to believe that they may be arrested on the accusation of having committed a non-bailable offence in connection with Case Crime no. 151 of 2019, under Sections 363, 366, 323, 420, 376, 120-B, 504, 506 I.P.C. and 3/4 POCSO Act, Police Station- Maduadeeh, District- Varanasi.
From the record, it is evident that the applicants have approached this Court after getting their anticipatory bail rejected from the court of sessions vide order dated 29.06.2021.
It is borne out from the record that the applicants are charge sheeted accused persons in case crime no. 151 of 2019, u/s 363, 366, 323, 420, 376, 120-B, 504, 506 I.P.C. and 3/4 POCSO Act with the allegations that the applicant no. 1 is real sister of opposite party no. 2 and the applicant no. 2 is her brother-in- law who has committed this heinous offence.
After perusing the record, I find no good ground to grant indulgence in favour of the applicants, accordingly, the present anticipatory bail application stands REJECTED.
