JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)
1. The present application is filed by the convict through Jail seeking temporary bail for a period of 45 days so as to undertake the agricultural operations due to the ensuing monsoon season.
2. Rule.
Mr. Patel learned APP waives service of rule on behalf of the respondent-State.
3. The applicant has been convicted for the offences punishable under sections 302, 114 and 504 of IPC to undergo imprisonment for life as awarded vide judgment dated 23.12.2008 in Sessions Case No. 38/2008. By now, he has undergone 4 years and 29 days as on 2.6.2012. He has enjoyed one temporary bail and reported in time. He has also enjoyed one furlough and reported in time. Nothing adverse is reported against the convict.
4. Taking into consideration the contents of the application, the same is allowed. The present applicant-convict is ordered to be released on temporary bail for a period of 30 days from the date of his release on his executing a personal bond of Rs. 5000/- (Rupees five thousand only) to the satisfaction of the Jail authorities.
5. The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute.
