JUDGMENT / ORDER

RULE.
Learned Additional Public Prosecutor Mr. L.B. Dabhi waives service of notice of Rule for the respondent - State.
It is submitted that the convict prisoner is in jail since the past more than 11 years. When the convict was released on furlough in the year 2004, he surrendered late by four days. Thereafter, the convict was never released either on parole / furlough / temporary bail. Pursuant thereto, the application for furlough in respect of the convict was granted on 15.02.2012 by the Office of the I.G. (Prisons), Ahmedabad with a condition to deposit a personal bond of Rs.25,000/- with like amount of surety. The application for reduction in the amount of deposit made by the convict was rejected by the competent authority. Hence, this application has been filed.
I have perused the relevant papers and am of the view that the applicant had surrendered late by four days when he was released on furlough. Prima-facie, his jail conduct also is good. Taking into consideration the above facts, this application is partly allowed and I deem it just and proper to modify and reduce the amount of personal bond from Rs.25,000/= to Rs.2,000/= (Rupees Two Thousand Only). The other conditions of the order dated 15.02.2012 passed by the Office of the I.G. (Prisons), Ahmedabad remain as they are.
Rule made absolute to the aforesaid extent. Direct Service is permitted.
