Learned advocate Shri Parmar made submissions at length on the issue of locus. He cited AIR 1966, S.C. pg. 828, (1995) 5 SCC pg.173 and AIR 1954 (Cal.) pg. 141 in support of his submission that the petitioner as a Senator has locus standi to maintain the petition under Article 226 of the Constitution of India for challenging Syndicate's Resolution passed by Academic Council under the M.S. University Act 1949. However, the Court was not inclined to entertain this petition, as prima facie the decisions cited at the Bar did not support the proposition with regard to locus in a Senator for challenging the Academic Council's resolution. However, Shri Parmar's request for adjournment to explore this issue in depth is accepted. At his request matter is kept on 8/2/2012.
