This writ petition has been filed with the prayer to issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 and 4 to make fair and proper investigation in Case Crime No. 1041 of 2018, under Sections 419, 420, 467, 468, 471, 120B IPC, P.S.- Cantt., District- Gorakhpur by some independent agency or any other competent authority except police station Cantt., District Gorakhpur.
Learned counsel for the petitioner, in support of his contention, has placed much reliance upon a letter dated 10.5.2019 which is under signature of SSP, Gorakhpur, contents of which are self explicit.
Looking to the controversy involved in issue and the contentions as have been raised at the Bar, no purpose would be served in keeping the matter pending before this Court any further.
Accordingly, the present writ petition is disposed of with a direction that in case the petitioner files an application raising his grievances therein along with the certified copy of the order and a copy of the writ petition before respondent no. 3 within a period of one months from today, the said application shall be heard and decided by means of a reasoned and speaking order within a period of two months thereafter by respondent no.
3. Respondent no. 3 while considering the said application may also consider the ramification of the communication, copy of which has been annexed at page no. 68 of the writ petition.
