Heard learned Counsel for the applicant and learned counsel for opposite party no.2.
This application under Section 482 Cr.P.C. has been filed for quashing the entire proceeding of Case No. 6692 of 2019 (State Vs. Narendra Kumar) arising out of Case Crime No. 1160 of 2019, under Sections 420, 406, 504 I.P.C., Police Station- Kotwali District- Jalaun, pending in the Court of Chief Judicial Magistrate, Jalaun at Orai.
It has been submitted by learned counsel for the parties that both parties have amicably settled the dispute and compromised the matter and that they have already filed the compromise before the Trial Court and same has been duly verified by the Trial Court, therefore, proceedings of impugned case be quashed on the basis of said compromise. However it has been admitted by the counsel for the parties that the offences are compoundable and the Trial Court itself is competent to decide the case being offences compoundable.
Under the facts and circumstances of the case, the parties are directed to move an application alongwith a copy of this order for deciding the aforesaid criminal case before the Trial Court which shall be considered and decided by the Trial Court within 15 days from the date of filing of such application.
With the aforesaid observation, this application is disposed of finally.
