Hon'ble Ajit Kumar,J.
In compliance of the earlier order of this Court, learned Standing Counsel has placed instructions before this Court today and the same is taken on record.
This petition under Article 226 of the Constitution of India as Public Interest Litigation has been filed for the following relief:
"(i) issue a writ, order or direction in the nature of mandamus commanding respondent nos. 2, 3 & 4 for removal of illegal encroachment over Plot No. 656 being chak road.
In the instructions that have been placed before this Court, there is a report of the Sub-Divisional Magistrate that the proceedings under Section 67(1) of the U.P. Revenue Code, 2006 have already been drawn against the persons who have unauthorizedly encroached the public utility land.
In view of the above, since the authorities have already proceeded in accordance with the procedure prescribed, no further orders are required to be passed in the present public interest litigation. However, It is expected that the authorities shall proceed to dispose of the matter as expeditiously as possible strictly in accordance with the procedure prescribed and following the principles of natural justice in the matter.
Writ petition is accordingly consigned to records.
