Present writ petition has been filed for issuance of writ of mandamus commanding respondents to conclude the enquiry as per the order dated 1.9.2020 passed by the District Magistrate, Smbhal within stipulated period of time.
Petitioner claims to have made a complaint against the Pradhan of Village- Akhtyarpur Thillupura, District-Sumbhal. Such complaint is alleged to be supported by an affidavit. The District Magistrate has initiated preliminary enquiry vide order dated 1.9.2020 but the concerned enquiry officer has not complied the said order till date.
Learned Standing Counsel states that the competent authority shall examine the grievance of petitioner, in accordance with law.
In the facts and circumstances of the case, this writ petition stands disposed of with the direction to respondent no.4 District Cane Officer, Sambhal as nominated by District Magistrate concerned shall conclude the enquiry in the matter in accordance with law, keeping in view the provisions contained under Rule 4(1) of the Uttar Pradesh Panchayat Raj (Removal of Pradhan, Up Pradhan and Members) Inquiry Rules, 1997 within a period three months from the production of certified copy/computerized copy of this order after affording opportunity of hearing to the Pradhan.
The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
