The prayer in this petition is to command the respondents to lodge a First Information Report against the sixth-respondent and to carry out fair investigation/enquiry.
If the sixth-respondent has committed a cognizable offence of which the petitioner has information/knowledge, the petitioner may lodge a first information report and if the same is not registered by the Police Station concerned, then the petitioner can take recourse to the alternative remedy under Section 156(3) of the Cr.P.C.
As an alternative remedy is available to the petitioner, without expressing any opinion with regard to commission of an offence by the sixth-respondent, we dispose of this petition by giving liberty to the petitioner to take recourse to other alternative remedies available in law.
