The matter purports to be filed under Section 482 CrPC for quashing the Complaint No. 161 of 2001 dated 01.01.2001 filed by the opposite party no. 2 and also the summoning order passed by Additional Chief Judicial Magistrate, Etawah dated 09.01.2002, u/s 406, 504, 506 IPC, P.S. Bakewar, District Etawah.
In the aforesaid matter the interim protection was granted to the applicant on 04.03.2004 and on the said date notice was also issued to the opposite party no. 2.
From the perusal of the record, it appears that Sri B. Ram has filed his Parcha on 12.05.2004 on behalf of the opposite party no. 2 but his name has not been printed in the cause list.
Today, when the matter was taken up in the revised list, the learned counsel for the applicant is not present before the Court. It appears that the applicant has lost interest.
Under the circumstances, the Court has no option but to dismiss the present application for want of prosecution.
However, it is left open to the applicant to move a proper application, if so he desired.
