Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents no. 1 to 3. Sri Rameshwar Prasad Shukla has accepted notice on behalf of the respondent no. 4 - Gaon Sabha.
Present writ petition has been filed seeking a direction to the Up- Ziladhikari, Tehsil Mehnagar, district Azamgarh to approve the fisheries lease dated 22.1.2018 granted by way of auction in favour of the petitioners forthwith without any further delay in the better interest of justice and also direct the authorities to permit the petitioners to operate the fisheries lease without any hindrance in accordance with law so that justice be done.
It is submitted that till date the approval has not been granted although the auction was struck in favour of the petitioner as back as in January, 2018.
Learned Standing Counsel submits that the grievance of the petitioner can be suitably looked into by the respondent no. 3.
Accordingly, this writ petition is disposed of with a direction to the respondent no. 3, the Up-Ziladhikari, Tehsil Mehnagar, district Azamgarh to pass appropriate orders on the representation of the petitioner, in accordance with law, preferably within a period of two months from the date of production of a self attested copy of this order, which may be verified from the official website of this Court.
It is made clear that this Court has not examined the case of the petitioner on merits.
No costs.
