Heard Sri Santosh Kumar Tiwari for the petitioner and Standing Counsel for State-respondents.
The writ petition has been filed against the notice of Executive Engineer dated 15.6.2016 mentioning therein that the petitioner will attain the age of superannuation on 31.12.2017.
On the basis of entry made in the Identity Card of the petitioner, this writ petition has been filed alledging that date of birth of the petitioner is 5.8.1961. Therefore, date of superannuation will be on 31.8.2021. On this allegation, the written instruction was called for from the Standing Counsel, who has produced the photostat copy of service book of the petitioner showing that date of birth of the petitioner was mentioned as 3.12.1957.
The Standing Counsel has also produced Seniority List published in the year 2003-04 showing that in the Seniority List, date of birth of the petition was mentioned as 3.12.1957 but no objection has been filed. Thus notice of superannuation does not suffer from any illegality.
The writ petition has no merit and it is dismissed accordingly.
