JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the engagement ceremony of his daughter scheduled on 19th April, 2012.
Pursuant to the earlier order of this Court dated 13th April, 2012, learned APP, Shri Pandya, has submitted that ground mentioned in the application is genuine. Since the convict is not enlarged on temporary bail on earlier occasion or on furlough leave, some more stringent conditions are required to be imposed. He has further submitted from the statement of the convict, it is ascertained that there is immovable property in the name of his wife worth not less than Rs.25,000/- and she is to stand as surety. Therefore, the following order.
Considering the totality of the facts, it is ordered that the applicant-convict shall be enlarged on temporary bail for a period of 10 days from the date of his actual release on personal bond of Rs.5,000/- and one surety having immovable property worth not less than Rs.25,000/- and documents in support of the property, in question, shall be submitted to the jail authority, which shall be returned to the said surety after the applicant surrenders to the jail authority.
Application is allowed to the aforesaid extent. Rule made absolute.
This order shall be intimated to the jail authority by learned APP, Shri Pandya.
