In deference to the order dated 16.04.2018, Dr. Sharad, Additional Inspector General of Prison Administration and Reform Services, U.P., Lucknow, Sri Amar Sen Singh, Special Secretary, Prison Administration and Reform Services, U.P., Lucknow and Sri S. P. Singh Sengar, Joint Secretary of the Department of Prison Administration and Reform Services, U.P., Lucknow are present.
An order has been produced by the learned A.G.A. passed on 24.04.2018 whereby the discrepancy occurring in the earlier Government Order dated 04.12.2017, as mentioned in our order dated 16.04.2018, appears to have been removed. The said Government Order dated 24.04.2018 is taken on record. Learned A.G.A. has also produced another order dated 18.04.2018 whereby the prayer of the petitioner for grant of home leave has again been rejected. The said order dated 18.04.2018 is also taken on record.
Sri Gaurav Mehrotra, learned counsel representing the High Court has produced before us the resolution of the Hon'ble Administrative Committee passed in its meeting held on 05.04.2018 whereby the rules/guidelines framed by the Hon'ble Committee under Section 432(2) of Code of Criminal Procedure pursuant to the direction given by the Hon'ble Supreme Court in Criminal Appeal No. 1215 of 2011, Union of India vs. V. Sriharan alias Murugan and others, have been approved. The resolution of Hon'ble the Administrative Committee along with the guidelines framed by the Hon'ble Committee are also taken on record.
List this case on 07.05.2018 as fresh.
At this juncture, the learned counsel for the petitioner stated that he may be permitted to amend the writ petition challenging the order dated 18.04.2018.
By the next date of listing, the petitioner is permitted to move appropriate application seeking amendment.
