JUDGMENT / ORDER

This petition is filed under Article 227 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 seeking direction to learned JMFC to issue process for the offences punishable under Section 406, 420, 465, 467, 471, 120(b) and 114 of the Indian Penal Code.
If the order dated 15.9.2011 passed by learned JMFC on the complaint filed by the petitioner herein is perused, learned Magistrate has already ordered inquiry under Section 202(2) of the Code, by which, the concerned PSI of Bagasara-Vadiya Police Station was directed to submit a report.
The grievances of learned advocate for the petitioner that inspite of the above order, no report is submitted and learned Magistrate or the concerned PSI, Bagasara-Vadiya be directed to expedite the inquiry.
The above submissions do not require any consideration on merit inasmuch as the learned Magistrate as well as the investigating agency are over burdened with such type of cases and no expeditious efforts can be made either by them.
The petition lacks merit and is hereby rejected.
