Heard learned counsel for the parties and perused the record.
By means of this contempt application filed under Section 7 of the Contempt of Courts Act, 1971, non-compliance of the order of writ Court dated 3rd December, 2019 passed in Writ- A No.- 19354 of 2019 is complained of.
Sri Narendra Kumar Tiwari, learned counsel for the opposite party has filed compliance affidavit which is taken on record, in which the order passed by the appellate authority deciding the appeal vide order dated 7th August, 2021 has been annexed.
Since the order was to decide the appeal on merits and order has been passed, no cause of action survives any more to maintain this contempt application.
Accordingly, notices, if any issued, are discharged and the contempt application is consigned to records.
It is always open for the applicant to challenge the order in appropriate proceedings at appropriate forum.
