No one is present on behalf of the petitioner even in the third call to press this petition. After second call a notice was put on the notice board that the case will taken up at 12 noon but no one has turned up.
Heard learned Standing Counsel and perused the record.
Present petition has been filed with a prayer to direct the respondents no. 2 to 4 not to interfere in the peaceful married life of the petitioners as husband and wife.
On 22.10.2019 following order was passed:
"Heard learned counsel for the petitioners and learned Standing Counsel for the State respondents.
By means of the present writ petition, the petitioners have prayed for a direction in the nature of mandamus directing the State-respondents to give them protection so that the private respondents may not interfere in their peaceful marital life. It is stated that their marriage was solemnized on 15.10.2019. The record of the case reveals that they are major. No F.I.R. has been registered against them. The record further reveals that the petitioners have approached the police before approaching the High Court.
Learned Standing Counsel states that as per the Government Order dated 31.8.2019, if the petitioners approach the police, the requisite protection shall be given to them.
Under such circumstances, a direction is being issued that as and when the petitioners approach the police, requisite protection would be given to the petitioners under the Government Order dated 31.8.2019. The petitioners would get their marriage registered under the Uttar Pradesh Marriage Registration Rules, 2017 within a period of two months. It is made clear that if the petitioners fail to get their marriage registered within the aforesaid period, the protection provided shall automatically stand withdrawn.
Put up this case on 27.11.2019 in the additional cause list, by which date the petitioner no.2 will produce before the Court proof of the fact that a Fixed Deposit receipt of Rs. 1,00,000/- of a nationalized bank in favour of the petitioner no.1 had been got prepared by the petitioner no.2.
No notice is being issued to the private parties. However, if they find that any false averment has been made in this writ petition, they can file for the recall of the order."
It appears that the order has not been complied with as there is nothing on record to indicate that the amount as directed has been deposited.
Interim order, if any, stands vacated.
Present petition stands dismissed for want of prosecution.
