Heard learned counsel for the petitioner and the learned Standing Counsel.
It has been pointed out that the order impugned, in terms of which the financial and administrative powers of the petitioner, a sitting Gram Pradhan, have been withdrawn, fails to allude to or consider the explanation which was proffered.
Learned Standing Counsel submitted that the ends of justice would merit the matter being remitted to the Collector for taking a decision afresh and in accordance with law.
Accordingly and with the consent of parties, this writ petition is allowed. The impugned order dated 06 July 2019 is hereby quashed. It is however left open to the District Magistrate to proceed in the matter afresh and in accordance with the 1997 Rules.
