Heard learned counsel for the applicant and learned A.G.A. for the State.
The applicant has approached before this Court praying for direction to the Additional Chief Judicial Magistrate, III Agra to decide the Criminal Case No. 1410 of 2011 (State Vs. Nahae Singh) arising out of crime no. 231 of 2003 under section 420 I.P.C.
P.S. Tajganj District Agra pending in the court of Additional Chief Judicial Magistrate,III, Agra within the stipulated time.
The argument is that trial is pending since 2003. The charges have been framed in the year 2012 as yet witnesses are not appearing for the last six months Without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court concerned to decide the aforesaid case within a period of six months from the date of production of certified copy of this order before him and also secure the presence of witnesses.
