Heard learned counsel for the petitioner.
By means of this application under Section 12 of Contempt of Courts Act, 1971, non-compliance of the order dated 25.02.2020, is complained of.
Upon perusal of the order dated 25.02.2020, it clearly transpires that the Civil Judge (Senior Division), Meerut was directed to consider the application for interim injunction under Order XXXIX Rule 1 & 2 C.P.C. filed by the applicant.
It is a widely known of fact that the entire state of Uttar Pradesh was badly hit by the surge of second wave of COVID-19 pandemic and both the public movement as well as judicial work were suspended due to lock down.
In such facts and circumstances, therefore, the pendency or delay in disposal of Order XXXIX Rule 1 & 2 C.P.C. cannot be said to be deliberate and wilful.
No contempt as such, therefore, is maintainable. However, it is expected as judicial proceeding has resumed in the district court, that the court concerned shall honour the order of this Court dated 25.02.2020 and shall dispose of the pending application quite expeditiously after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, preferably within a period of two months from the date of filing of copy of this order.
This contempt application stands disposed of accordingly.
