Heard Sri Surendra Kumar, learned counsel for the petitioner, learned Standing Counsel for the respondent No.1, Sri Baleshwar Chaturvedi for the respondent No.2 and Sri Ashutosh Srivastava for the respondent No.3.
The petitioner was involved in theft of electricity and accordingly a show-cause notice was issued to him. He did not file any reply but submitted objections which are pending consideration before the respondent No.3. The said objections are required to be dealt with after affording opportunity of hearing to the parties concerned. It is informed that the petitioner is avoiding appearance and, as such, the objections raised by him could not being decided.
In view of the aforesaid facts and circumstances, we direct the petitioner to appear before the respondent No.3 on 10th June, 2019, whereupon the respondent No.3 shall hear him and decide the objections. In case it is not possible for any reason to complete the hearing and decide the objections on said date, another date shall be fixed so as to enable the respondent No.3 to complete the hearing and decide the objections within a period of six weeks from today.
With aforesaid observations the writ petition is disposed of.
