Prima facie, the preliminary objection raised by Mr. Naik, learned counsel, requires serious consideration in view of the decision of the Apex Court reported in AIR 2007 SC 1812 more particularly observations made in para 40, 41 and 42. However, Mr. Shah, learned counsel for the petitioner request for time. S.O. to 18.07.2012.
