1. On account of death of four persons having consumed spurious liquor, a departmental inquiry is under contemplation and pursuant thereto petitioner, working as Excise Inspector, Kshetra-3, Kanpur Dehat has been placed under suspension.
2. Learned counsel for petitioner submitted that petitioner is not expected to take care of every corner of the area and even otherwise he is not responsible for the incident.
3. That is a matter of defence, which is to be seen in departmental inquiry. At this stage, this Court has to see only whether impugned order of suspension is contrary to rules or has been passed by incompetent authority or is otherwise vitiated in law on account of mala fide etc. Since in the case in hand, none of the aforesaid grounds exist, we find no reason to interfere.
