Rule.
Mr.Nanavati, learned APP appears and waives service of rule for respondent - State.
The instant application is filed seeking temporary bail for a period of four weeks in connection with Danilimbda police station, Dist.Ahmedabad C.R.No.I - 96 of 2011 on the ground that the wife of the applicant delivered a pre-matured child and the condition of the wife and child is critical and the child is admitted in incubator.
Having considered the submissions advanced on behalf of both the sides, so also considering the medical papers annexed, this Court is of the opinion that the application deserves to be allowed in part.
The application is partly allowed and the applicant is ordered to be released on temporary bail for the period of 10 days from the date of his actual release on his furnishing personal bond of Rs.10000/- (Rupees ten thousand only) with one surety of the like amount to the satisfaction of the concerned jail authority. Upon completion of period of temporary bail, the applicant shall immediately surrender before the concerned jail authority.
Rule is made absolute to the aforesaid extent. D.S.P.
