Applicant has filed this Application for bail, pending the above mentioned Criminal Appeal.
Heard learned Advocate Mr. Nanavati for the applicant and learned APP Mr. Jani for the respondent - State.
Learned Advocate Mr. Nanavati has contended that earlier the applicant has filed Criminal Misc. Application No.6280 of 2011 for bail. The said application came to be dismissed as withdrawn. However, this Court has granted liberty to the applicant to file fresh application for bail if the main Criminal Appeal No.559 of 2011 is not heard and finally decided within six months. He has contended that though the period of six months is already over, his Appeal is not heard and decided finally. He, therefore, prays that the applicant may be released on bail, pending the hearing of above Appeal.
In the facts of the case, the prayer for bail is not required to be granted. However, the Office is directed to place the main Criminal Appeal for final hearing on 12.3.2012.
Accordingly, this application is disposed of. Notice is discharged, subject to the aforesaid direction.
