Rejoinder affidavit filed today by learned counsel for the applicant is taken on record.
Heard learned counsel for the parties and perused the material brought on record.
It is contended by learned counsel for the applicant that applicant has been falsely implicated in the present case due to ulterior motive. It is next contended there is delay in lodging the First Information Report without any plausible explanation. The applicant has neither kidnapped the victim or harassed the victim. The daughter of the informant left her house on her own sweet will. The applicant is in jail since 18.12.2019.
Learned A.G.A. has vehemently opposed the bail prayer of the applicant without disputing the aforesaid submissions of the learned counsel for the applicant and submitted that in case applicant is released on bail he will misuse the liberty of bail.
After hearing the learned counsel for the applicant and learned AGA, and after perusing the averments made in the present bail application this Court is of the opinion, that learned counsel for the applicant could not point out any good ground for grant of bail to the applicant.
Accordingly, application for grant of bail to the applicant- Mushrraf, who is involved in Case Crime No. 0644 of 2019, under section- 363, 305 IPC, Police Station- Tilhar, District- Shahjahanpur, is hereby rejected.
However, considering the facts and circumstances of the case, it is expected that the court concerned shall conclude the trial expeditiously preferably within a period of six months if possible, from the date of production of a computer generated copy of this order, if there is no legal impediment.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad. The concerned Court shall verify the authenticity of such computerized copy of the order from the official website of High Court, Allahabad.
