ORDER:
The petitioner has filed a private complaint against respondents 1 to 3, before the VI Chief Metropolitan Magistrate, Hyderabad. In the complaint, it is alleged that respondents 1 to 3 have committed offences punishable under Sections 120-B, 420, 406, 467, 468, 471 and 477 of IPC. The said complaint was referred to the Police for investigation, by the said Court, as contemplated under Section 156(3) Cr.P.C. Initially, the matter was inquired into by the Asifnagar Police Station, and subsequently, it was referred to the Central Crime Station. In the Central Crime Station, the crime is registered as Crime No.45 of 2008, and after completing investigation, Final Report No.1 of 2009 is already submitted to the Court, stating that it is a case of lack of evidence and such a report is also served on the petitioner. It is submitted that the petitioner has also filed objections to the final report before the learned Magistrate.
In this writ petition, the petitioner disputes the contents of the final report and seeks directions to refer the matter to C.B.I. for inquiry.
As much as the petitioner has already filed objections on the final report, the said objections can be considered by the Magistrate, but even before such objections are considered, by disputing the final report, the petitioner cannot seek directions for transfer of inquiry to the C.B.I.
For the aforesaid reasons, I do not find merit in this writ petition for grant of directions as prayed for. The writ petition is devoid of merit and it is accordingly dismissed. No order as to costs.
