Heard learned counsel for the petitioner and learned Standing Counsel.
The petitioners are before this Court for a direction to second respondent to decide restoration application of the petitioners for restoring the Case No.07 of 2008 under Section 33/39 of L.R. Act over Arazi Land Pargana, Tehsil and Distt. Mainpuri (State v. Rani Ratnesh Kumari) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of finally with a direction to the second respondent to consider and decide the aforesaid restoration application in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost.
