As per prosecution case, deceased who is the elder daughter of the complainant was married with one Rajat Singh; victim was subjected to harassment for dowry by the in-laws, including, the applicant; consequently, victim was burned and she succumbed to her injury.
Learned counsel for the applicant submits that the statements are contradictory; it is an accidental death; there is no allegation of demand of dowry; applicant is mother-in-law and no specific role has been assigned to her; applicant is languishing in jail since 17.05.2018.
Learned A.G.A. has pointed out that the victim in her statement under section 161 Cr.P.C. and in dying declaration has categorically stated that her husband, in- laws and in particular the applicant were instrumentally causing burn injury for dowry.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Munni Devi involved in Case Crime No. 09 of 2018, under Section 302 I.P.C., P.S. Madanpur, District Shahjahanpur.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of one year from the date of production of a certified copy of this order, if, there is no legal impediment.
