Heard Sri Ram Datt Dauholia, learned counsel for the applicant and Sri Ajay Kumar Pathak, learned AGA appearing for the State.
This bail application moved on behalf of applicant praying to enlarge the applicant on bail in Case Crime No.902 of 2018, under Sections 366-A, 376-D, 344, 346, 328, 120-B, IPC, and under Sections 3, 5, 6 of Immoral Traffick (Prevention) Act, 1956 and also under Section 5/6 POCSO Act, Police Station Kotwali, District Lalitpur.
The counsel for the applicant has claiming parity of the applicant from co- accused Salman and Irfan, who have been granted bail by another Bench of this Court by means of an elaborate and reasoned orders dated 08.04.2019 and 11.04.2019, passed in Criminal Misc. Bail Application No.14192 of 2019 and 15197 of 2019, respectively. The copy of the order has been produced by the counsel for the applicant is taken on record. The applicant is in jail since 05.08.2017 with no previous criminal history.
Sri Ajay Kumar Pathak, learned AGA appearing for the State has opposed the prayer for bail, but could not dispute the aforesaid facts as argued by the learned counsel for the applicant.
Keeping in view the reasons as stated above, the facts and circumstances of the case as have been discussed at the Bar of this Court, without expressing any opinion on the merits of the case, at this stage, prima facie, a case for bail has been made out. However, the said prima facie view of this Court will not in any manner adversely affect the case of the prosecution.
The prayer for bail is granted. The application is allowed.
Let the applicant Munna Parihar involved in the aforesaid case crime number be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
