Counter affidavit filed on behalf of the State and Sri Wahid Jamal, Advocate, has filed his vakalatnama on behalf of opposite party no. 2, are taken on record.
Heard learned counsel for the applicant, learned AGA and perused the record.
By means of this application, the applicant who is involved in case crime no. 475/2017, under Sections 376, 511 IPC and 5K, 5M/6 POCSO Act, P.S. Etmadpur, District- Agra is seeking enlargement on bail during the trial.
Contention raised by the counsel for the applicant that the applicant is innocent. He has been falsely implicated in the present case. Sri Wahid Jamal, learned counsel for the opposite party no. 2 submits that the applicant is sole named accused in the FIR and the allegation against him is that he has committed rape upon a mentally retarded minor girl aged about 9 years. As per the medical report, there is redness in her libia mejara, which clearly indicates that she was sexually exploited by the applicant.
Under the circumstances, I do not find any good reason to grant indulgence to the applicant. Consequently, the bail application stands rejected.
It is expected that the learned trial court would gear up the trial and would make necessary endeavour to conclude the same by 31.12.2019.
