1. Learned Advocate for the applicant was granted time to produce papers of treatment taken by the convict after he was granted temporary bail by this Court by order dated 17.05.2012.
2. Learned Advocate for the applicant states that the papers are awaited, but a Pathology Laboratory report, wherein it is mentioned that the case was referred y one Dr.D.B.Dekivadiya,, is available and the same is produced before the Court for perusal. Besides, learned Advocate for the applicant invited attention of the Court to a certificate issued by Resident Medical Officer, General Hospital, Junagadh. Learned Advocate for the applicant states that while the applicant was under treatment of a private Doctor, the Doctor advised him to take treatment from Civil Hospital and therefore, he has taken treatment from Civil Hospital. The certificate is dated 11.06.2012. The learned Advocate states that the certificate is issued stating that he has suffered stroke and also suffering from kidney ailment. The contents of certificate are not legible. However, taking into consideration the fact that the present application is for extension, it is taken up for consideration.
3. RULE.
Mr.L.R.Pujari, learned Additional Public Prosecutor waives service of Rule on behalf of the respondent-State.
4. For the contents of the application, the same is allowed. The temporary bail is extended for a period of 30 (thirty) days from the date of expiry of the earlier temporary bail period.
5. The convict shall surrender to the Jail authorities on expiry of the temporary bail period.
6. Rule is made absolute.
Direct service permitted today.
