Heard Sri Ravindrra Kumar Mishra, learned counsel for the petitioner, Sri Baleshwar Chaturvedi, learned counsel for the respondents Power Corporation, learned Standing Counsel appearing for the State and perused the record.
By means of this writ petition under Article 226 of the Constitution of India, the petitioner has sought a direction in the nature of writ of mandamus commanding the respondents to provide him a new electricity connection to his premises.
Learned counsel appearing for the Power Corporation per contra submits that the new connection cannot be granted to the petitioner as the premises in question is one and the same having already electricity connection in respect of which there are already outstanding dues inasmuch brother of the petitioner in whose name electricity connection stands has been found to be indulged in an act of theft and in that regard an FIR has also been lodged.
We made a pointed query to the learned counsel for the petitioner as to how he can claim for a new connection when the premises is the same, he could not come out with any plausible answer to the query made.
In view of the above, the relief prayed for by the petitioner cannot be granted in the facts and circumstances of the present case. However, it is always open for the parties to clear the dues and get the electricity connection restored to the already installed meter.
The writ petition lacks merit and is, accordingly, dismissed.
