Heard learned counsel for the applicant and the learned AGA.
The present application u/s 482 Cr.P.C. has been filed with a prayer to direct the learned Addl. Sessions Judge/Special Judge (Anti Corruption Act), Court No. 4, Gorakhpur to decide S.T. No. 400 of 2015 (State Vs. Mustafa & others) arising out of Case Crime No. 22 of 2015, under Sections 304, 504, 506 IPC, P.S. Chiluawatal, District- gorakhpur expeditiously within stipulated period.
Learned counsel for the applicant has submitted that applicant is the first informant and charges in the present case have already been farmed on 4.8.2016, however, since then the trial has been pending and lingering-on, on one pretext or the other and has not yet been concluded.
In view of the above, the Addl. Sessions Judge/Special Judge (Anti Corruption Act), Court No. 4, Gorakhpur is expected to make all endeavours to decide the aforesaid case expeditiously, preferably within a period of ten months from the date of filing of certified copy of this order after giving opportunity of hearing to both the parties without giving any unnecessary adjournments to either parties and there is no other legal impediment in deciding the aforesaid case.
With the aforesaid observations, the application u/s 482 Cr.P.C. is finally disposed of.
