This writ petition has been filed for issuing of mandamus directing the respondent nos. 2 and 3 i.e. Senior Superintendent of Police, Gautam Budh Nagar and Station House Officer, Police Station- Phase III, District Gautam Budh Nagar to ensure the fair and impartial investigation in pursuance of F.I.R. dated 13.11.2018 registered as Case Crime No. 1634 of 2018, under Sections 498A, 304B I.P.C. & 3/4 Dowry Prohibition Act, Police Station- Phase III District- Gautam Budh Nagar.
It is alleged that F.I.R. was lodged on 13.11.2018 but police is not proceeding in the matter.
In the facts of present case, writ petition is disposed of with the direction to respondent nos. 2 and 3 i.e. Senior Superintendent of Police, Gautam Budh Nagar and Station House Officer, Police Station- Phase III, District Gautam Budh Nagar to ensure the fair and impartial investigation in pursuance of F.I.R. dated 13.11.2018 registered as Case Crime No. 1634 of 2018, under Sections 498A, 304B I.P.C. & 3/4 Dowry Prohibition Act, Police Station- Phase III District- Gautam Budh Nagar and submission of report by Investigating Officer under Section 173(2) Cr.P.C. as early as possible.
