This Court has granted an order of status quo in the above Writ Petition in W.P.(MD)No.12099 of 2017 and Miscellaneous Petitions in W.M.P.(MD) Nos.9332 and 9333 of 2017 which were filed to stay all further proceedings pursuant to the impugned order dated Nil.05.2017 and to pass order of ad interim injunction restraining the respondents from interfering with the regular activities of the petitioner in the post of District Inspector of Physical Education, Theni District, pending disposal of the Writ Petition.
2.The impugned order, which was challenged in the Writ Petition by which the petitioner was relieved from the post in which he was in charge, was stayed. By virtue of the order of status quo the respondents are directed to maintain status quo so that the petitioner will be in a position to continue. However, it appears that after the order of this Court, by proceedings dated 28.07.2017, the petitioner was relieved from the post which he was holding with a liberty to the petitioner to file an appeal as against the order. It was further stated that the order of Chief Educational Officer, Theni, will be subject to the order that may be passed by the appellate authority or the finial order that may be passed in the main Writ Petition. Realising that the order that was passed by the respondent after the order of status quo is in disobedience and utter disregard to the order passed by this Court in W.M.P.(MD)Nos.9332 and 9333 of 20170, the second respondent has passed an order on 05.09.2017 withdrawing the earlier order that was passed on 28.07.2017. The status quo as on the date of order passed by this Court has been restored by proceedings of the second respondent dated 05.09.2018.
3.Recording the same, this Contempt Petition is closed. No costs.
