M.Palanipriya @ Palaniammal vs M.Shanmugapriyan

Madras High Court|09 June, 2017

JUDGMENT / ORDER

The wife, who is the respondent in O.P.No.297 of 2017 on the file of the Family Court, Chennai, is the petitioner. She seeks transfer of the same to the file of the Sub Court, Paramakkudi. The transfer is sought for mainly on the ground of convenience of the petitioner/wife. She alleges that she is residing in her parents' house at Paramakudi.
2. Even in the Original Petition in O.P.No.297 of 2017 filed before the Family Court, Chennai, the petitioner/wife is shown to be a resident of Paramakudi.
3. Though the respondent/husband has been served on 08.04.2017, he has neither chosen to appear in person nor he has engaged a Counsel duly instructed.
4. Considering the convenience of the petitioner/wife and the fact that the proceedings before the Family Court requires the presence of parties for every hearing and also taking into account the distance between Chennai and Paramakudi, I deem it fit to withdraw O.P.No.297 of 2017 from the file of the Family Court, Chennai and transfer the same to the file of the Sub Court, Paramakudi. The Family Court, Chennai, is directed to transmit the papers in O.P.No.297 of 2017 to the file of the Sub Court, Paramakudi, within a period of two weeks from the date of receipt of a copy of this order.
6. In the result, this Transfer Civil Miscellaneous Petition is ordered as above. No costs. Consequently, the connected civil miscellaneous petition is closed.
To
1.The Family Court, Chennai.
2.The Sub Court, Paramakudi..
