By this Transfer Application, the applicant seeks transfer of Case No.2019541429000310 State Vs. Agnoo and Others, pending before the Settlement Officer of Consolidation, Ghazipur, to a Court of competent jurisdiction in some adjoining district. The Settlement Officer of Consolidation functioning under the U.P. Consolidation of Holdings Act, 1953 is not a Court subordinate to this Court, as contemplated by the Code of Civil Procedure, 1908. The Code does not apply to the Consolidation proceedings.
In this view of the matter, this Transfer Application under Section 24 CPC is not maintainable.
This application for transfer under Section 24 CPC is, therefore, dismissed as not maintainable.
It will, however, be open to the applicant to seek such other remedies for the purpose, as may be advised.
