The report of of the Chief Judicial Magistrate, Azamgarh, dated 31.3.2018 in compliance of the orders dated 23.2.2018 and 4.4.2018 has been received indicating that the sole appellant Mool Chand had died about 8 years ago. The inquiry was conducted with respect to the death of the appellant Mool Chand as per circular of this Court. Hence on account of death of abovementioned appellant, the appeal has lost its efficacy.
Accordingly, the appeal on behalf of the appellant Mool Chand stands abated.
The record of appeal be consigned.
The record of lower court be remitted back to the court concerned forthwith along with the copy of this order for communication and necessary compliance.
