Heard Shri D.V. Singh, learned counsel for the petitioner and Shri A.K. Pandey, learned counsel for the respondent nos.3 and 4.
In pursuance of the order dated 21.05.2019, the petitioner has shown his bonafide by handing over the cheque of Rs.1,54,00/- bearing no.009700 dated 29.05.2019 of The New Urban Co-operative Bank Ltd. Rampur, to the learned counsel for the Bank. The same is accepted by the learned counsel for the Bank.
The petitioner has prayed that he may be allowed to pay the balance amount in easy instalments in pursuance of the recovery notice dated 15.05.2019.
Learned Counsel for the contesting respondent has no objection in accepting the amount in easy instalments.
Accordingly, this Court fixes three equal monthly instalments for the balance amount to be paid by the petitioner. The first instalment will become payable on 30th of June, 2019 and the rest two instalments will be paid by the petitioner on the 30th day of each succeeding month.
In case, the petitioner deposits the amount in instalments as stated above, no coercive measures regarding recovery may be taken against the petitioner. Failure to deposit any instalment within time as stated above will leave it open to the respondents to proceed in accordance with law.
With the aforesaid observations, the writ petition stands disposed of. No costs.
