This application u/s 482 Cr.P.C. has been filed seeking the quashing of impugned order dated 21.02.2018 passed by the Additional District and Sessions Judge/F.T.C. First, Siddharth Nagar in Criminal Revision No.168/2016 (Sant Saran vs. Mohrat and others) arising out of criminal Complaint No.326 of 2016, u/s 420, 465, 467, 468, 471, 474 I.P.C., P.S.-Siddharth Nagar, District-Siddharth Nagar.
Heard learned counsel for the applicants and learned A.G.A. and also perused the record.
Counsel for the applicants has not been able to point out any such illegality or impropriety much less than any abuse of court's process which may persuade this Court to interfere in the impugned order. The lower revisional court observed certain infirmities in the judgement passed by the court of Magistrate and the documents that were available on the record like copy of will deed, copy of Khatauni, copy of Jot Aakar Patra-51, Jot Aakar Patra 54 etc. and were wrongly ignored by the court of Magistrate. The lower revisional court was of the view that these were the documents which were to be considered and with these observations the matter was remanded back. This Court does not see anything wrong in the approach of lower revisional court.
The application lacks merit and therefore stands dismissed.
