Heard learned counsel for the applicant and learned A.G.A. For the state.
The present application has been filed for setting aside the impugned judgment and order dated 31.08.2017 passed by the learned Additional Chief Judicial Magistrate in Complaint Case No. 734 of 2015 (Smt. Rekha Gupta Versus Mohit Kumar Gupta @ Billu and others), under Sections 323, 498A, 504, 506 I.P.C. and 3/4 D.P. Act, Police Station Milak, District Rampur, by which the applicant has been convicted the offence under Section 498A I.P.C. It is further contended that the said order has been challenged in Criminal Appeal No. 52 of 2017 (Mohit Kumar Gupta @ Billu Vs. State of U.P.) before learned District & Session Judge, Rampur, and during pendency of that appeal, parties have entered into compromise on 16.07.2018, copy of same has been filed by the applicant before the learned District & Session Judge, Rampur through application dated 23.01.2019 (copy of the compromise deed annexed at page 47-48 of the paper book).
Let the compromise be filed before the concerned court for verification of the same after issuing notice to the parties, which exercise shall be done within a period of one month from the date of production of the certified copy of this order before the court concerned.
Learned counsel for the applicant undertakes to furnish certified copy of the order passed by the concerned court below within a period of two weeks of passing of the said order.
List after six weeks.
