We heard learned counsel for the appellant.
Status-quo has been taken by the court below.
We have directed issuance of notice on 15.12.2021 making it returnable on 24.12.2021 as there was an urgency. The learned counsel for the appellant has not taken steps. We have directed that the suit shall not proceed further, be that as it may, therefore, we modify the same order by fresh notice to issue returnable in the month of March, 2022 as it appears that there is no urgency otherwise the learned counsel for the appellant shall have taken steps when first order was passed.
Meanwhile, the suit shall not proceed, further, the respondent shall not make any constructions on the property during this period rather to maintain status-quo.
List the matter in the month of March, 2022.
If now the steps are not taken, the appeal shall stand dismissed automatically.
