Heard learned counsel for the petitioner and learned A.G.A. for the State and perused the record.
This writ petition has been filed by the petitioner with a prayer in the nature of mandamus directing the Superintendent of Central Jail Naini, Prayagraj to sent the petitioner in the judicial custody before the Court of Sessions Judge, Bokaro, Jharkhand in pursuance of B. Warrant dated 10.07.2018 and 24.09.2018 in Case Crime No. 32 of 2018, under Section 326, 27(1) I.P.C., P.S. Nawadeeh, District Bokaro, State Jharkhand.
Upon perusal of the material brought on record, it transpires that the petitioner before filing this writ petition had already moved an application before the Special Judge, Gangster Act, Allahabad on 15.09.2018 (Annexure No.2) with the same prayer, which has been made by him in this writ petition, but the said application has not been decided till date.
In view of the above, without expressing any opinion on merit, we disposed of this writ petition with a direction to the Special Judge, Gangster Act, Allahabad to decide the application of the petitioner within a period of two weeks from the date of production of certified copy of this order.
