Heard Mr. Sudhakar Yadav, learned counsel for the revisionist and the learned A.G.A. for the State.
This criminal revision is directed against the order dated 23.2.2018 passed by the Appellate Court that is the Additional Sessions Judge, Court No. 6, Shahjahanpur, in Criminal Appeal No. 18 of 2018, (Mohd. Sanam and others Vs. Smt. Tabassum and another) arising out of judgement and order dated 17.3.2016 passed by the Additional Civil Judge (J.D.)/Judicial Magistrate Ist, Shahajahanpur, in Case No. 252 of 2013, (Smt. Tabassum Vs. Mohd. Sanam), under sections 17, 18, 19, 20, 21 and 22 of the Protection of Women From Domestic Violence Act, 2005.
It is an undisputed fact that the opposite party No. 2 is the legally wedded wife of the revisionist and the opposite party No. 3 is the minor son of the revisionist. The revisionist is under legal and moral obligation to maintain both of them. There is nothing on the record to suggest that the revisionist had taken due care and diligence to maintain his wife and his minor son.
This being the position, no occasion arises before this Court to entertain the present criminal revision.
The criminal revision is dismissed.
